In January 2025 new provisions amending the act the on energy market came into force aiming at the introduction of so – called “supplementary auctions” which will be carried out within four supply periods: in 2025 (semi-annual auction) in the period between 1st July and 31st December and (annual auctions) in the period from 1st January and 31st December. Supplementary auctions will follow the additional auctions of the energy market which means they will be conducted earlier in relation to the moment of the beginning of the obligation to supply power .
The new law is aimed at the use of REGULATION (EU) 2024/1747 OF THE EUROPEAN PARLIAMENT AND OF THE COUNCIL of 13 June 2024 amending Regulations (EU) 2019/942 and (EU) 2019/943 as regards improving the Union’s electricity market design. The supplementary auctions will indeed extend the existing processes of the energy market and help the energy market to leverage remaining resources.
In this month also a new act subject to entities serving credits and purchasers of credits was introduced which implements regulation of the DIRECTIVE (EU) 2021/2167 OF THE EUROPEAN PARLIAMENT AND OF THE COUNCIL of 24 November 2021 on credit servicers and credit purchasers and amending Directives 2008/48/EC and 2014/17/EU into the Polish legal system (hereinafter: “Directive”). The new act lays down, among other things, rules for commencing and conducting activities within the serving of credits, rights and duties of institutions issuing and serving credits, purchasers of credits and representants of purchasers of credits from non – member states, consequences for breach of duties and rules about maintaining supervision over the entities serving the credits, providers of credit services and purchasers of credits. Providing of activities subject to the serving of credits will require authorization from the Polish Financial Supervision Authority (KNF) and KNF will decide about this by the way of a decision. It should be stressed that a register containing the list of entities serving credits will be made publicly available online and this register will also be published on the website of KNF.
The Polish legislator has also implemented changes to the act on providing health services financed through public means which, among other things, sets aside any limitations connected with the possibility of issuing receipts for some refunded drugs, food products for special nutrition or other medical products to which persons under the age of 18 are entitled to or after passing the age of 65. Every person authorized can issue receipts for drugs free of charge and other means due to his/her medical occupation if this right to do this is provided by law. This new law has also brought changes to pharmaceutical law enabling pharmacists to issue pharmaceutical receipts also for immunological products (injections). Persons engaged by pharmacists can also forgo their right to claim additional (flat – rate) remuneration due to force majeure or random reasons.
Finally new provisions were enacted in the scope of aviation law according to which the obligation of introducing urban development plans will be repealed in areas subject to (general) airport plans for public use. In addition, any coordination undertaken by the president of the office for civil aviation for areas in which an airport shall be built in line with approved general airport plans will also have especially bearing on local development plans of municipalities and on decisions for building conditions.
