April saw amendments to the Act on the Trade in Goods, Technologies, and Services of Strategic Importance to State Security and the Maintenance of International Peace and Security<\/strong>\u2014legislation crucial from the standpoint of security and the geopolitical situation\u2014as well as to the Act on conducting business activities involving the manufacture of and trade in explosives, weapons, ammunition, and products and technologies for military or police use.<\/p>\n

This month also brought changes to the Energy Law<\/strong> and certain other acts, addressing several key objectives regarding the functioning of Poland\u2019s energy market, specifically concerning:<\/p>\n

    \n
  1. rules for connecting generation sources to the electricity grid,<\/li>\n
  2. strengthening the position of consumers in the electricity market,<\/li>\n
  3. streamlining the planning process for electricity grid development (transmission and distribution) and connection timelines, while simultaneously optimizing costs and outlays associated with grid connection.<\/li>\n<\/ol>\n

    Regulations under the Act on Investment Funds<\/strong> and the Management of Alternative Investment Funds and the Act on Trading in Financial Instruments were also amended this month. These changes are part of an effort to deregulate and simplify the operations of non-public closed-end investment funds (FIZ) by restoring the option to register non-public FIZ investment certificates outside the Central Securities Depository of Poland (KDPW). Registration with the KDPW remains mandatory only for public FIZs. The entity maintaining the register will be required to keep it in electronic form and transmit data to the KDPW regarding the certificates and any fulfilled or due obligations. A change in the registration system (e.g., from the KDPW to a separate register) will require the consent of the investors’ meeting.<\/p>\n

    The legislature has enacted a significant amendment to the Act on the National Labor<\/strong> Inspectorate and certain other acts, granting the Inspectorate new powers. The amendment strengthens the National Labor Inspectorate to ensure more effective and efficient enforcement of labor law compliance, particularly regarding the improper substitution of employment relationships with civil law contracts. Concurrently with the changes to the Act on the National Labor Inspectorate, amendments were also introduced to, among others, the Code of Civil Procedure and the Labor Code (including an increase in fines for offenses against employee rights).<\/p>\n

    This month saw the publication of the Act on Data Governance<\/strong>, designed to ensure the implementation of Regulation (EU) 2022\/868 of the European Parliament and of the Council of 30 May 2022 on European data governance and amending Regulation (EU) 2018\/1724 (the Data Governance Act or DGA). The DGA entered into force on 23 June 2022 and has been directly applicable in all Member States since 24 September 2023. This new legislation complements the aforementioned Regulation in areas where the EU legislator granted Member States discretion to shape the institutional, organizational, and regulatory framework required for the application of the DGA\u2019s provisions. In April, an act entered into force authorizing the President of the Republic of Poland to ratify the Agreement between the Republic of Poland and the Republic of Indonesia on Mutual Legal Assistance in Criminal Matters, signed in Warsaw on September 19, 2025. The agreement governs the provision of assistance regarding pre-trial and judicial criminal proceedings; however, it does not cover extradition, the transfer of criminal proceedings, the transfer of convicted persons for the purpose of sentence enforcement, or the enforcement of criminal judgments. It is a much-needed agreement, as there are currently no bilateral regulations governing Polish-Indonesian cooperation in criminal proceedings, and all requests (from either side) are handled solely on the basis of reciprocity and good will.<\/p>\n

    Last but not least, amendments were made to the Aviation Law <\/strong>and certain other acts to implement the provisions of Regulation (EU) 2023\/2405 of the European Parliament and of the Council of 18 October 2023 on ensuring a level playing field for sustainable air transport (ReFuelEU Aviation). These changes concern the uptake and supply of sustainable aviation fuels and the establishment of a legal framework for the effective enforcement of obligations imposed on aircraft operators, EU airport managing bodies, and aviation fuel suppliers.<\/p>\n","protected":false},"excerpt":{"rendered":"
